PROTECTIVE COVENANT SUMMARY SAN PEDRO CREEK ESTATES

To protect residents as well as wildlife, San Pedro Creek Estates has a set
of sensible restrictive covenants, the most important of which are summarized here:

|
No Perimeter Fencing. Fencing an entire parcel would disrupt wildlife, their
movement corridors and look commercialized. Horses are to be maintained in a corral area not to exceed 10,000 square
feet.

|
Pets must be on a leash or kept within a fenced area. Pets should not be
a nuissance or threat to wildlife or neighbors. Pets can enjoy the many trails in San Pedro Creek.

|
|
|
A minimum 100 foot setback from property lines. In most cases this creates
hundreds of feet as a buffer zone between homes.
|
|
All utilities are underground. This will help ensure the open spaces have uninterrupted
views.

|
|
|
The Architectural Control Committee (ACC) must first approve all building and fencing materials.
This will help to maintain the visual integrity within the community.
|
|
No mobile homes, even during construction. This is not only maintain the integrity
of the development, but also help to keep investment values up.
|

|
|
|
Lighting control to minimize light pollution. Residents will be able to enjoy
New Mexico's glittering night skies with minimal to no light pollution.
|
|
Motor homes, clotheslines, propane tanks, and water storage tanks must be kept out of sight.
With such large lots, keeping things orderly is easy.

|
|
|
Color schemes that blend into the natural environment. San Pedro Creek Estates
makes every effort to use only colors found within the natural landscape.
|
|
No on-street parking. San Pedro Creek Estates' paved roads are maintained
for effortless travel, and all vehicles must be kept in proper parking areas.
|
| |
|
|
|
Integrate homes into the landscape. Structures should strive to enhance the native
splendor.
|
|
The San Pedro Creek Homeowners Association controls the trail system. The trail
system is one of a kind, and the Homeowners Association has direct control over the design and containment of trails into
the Nature Area.

|
|
|
No buildings will break the ridgeline on a focal mountain; the natural tree line marks the height
of the ridgeline. Preservation of the view sheds is a critical aspect of our community.
|
|
Roads are private. There is one entrance/exit for the entire development; low
travel speeds (10-20 mph) are posted along the well-paved roads.

|
|
Main residence will be a minimum of 1,800 square feet. A guest home is allowed with a separate
kitchen (minimum 900 square feet). A guest home will provide privacy for visitors.
|
|
All major arroyos/drainage ways shall remain in their natural state. Lot owners
must avoid interrupting these natural drainage ways for obvious reasons.

|
Nature preserve will remain natural. The 625+ acre nature preserve will contain
no buildings or artificial items of any kind.
|
|
Natural vegetation shall be left undisturbed except for access to property, clearing of building
sites, and establishment of lawns or gardens. Lawns, gardens, and certain landscaping are permitted; however,
many residents are happy to leave their lawnmowers and rakes behind.
